Bodega Worker Charged With Murder After Stabbing Man Who Allegedly Attacked Him Because His Girlfriend’s EBT Card Declined

A Manhattan bodega clerk who was forced to grab a knife to fend off a violent customer is now in jail and being charged with murder.

In the footage, you can see Jose Alba, 51, being confronted by his alleged victim, Austin Simon, 35. It all started because Simon’s girlfriend got into an argument with Alba about her declined transaction.

According to police, Simon’s girlfriend, EBT debit card declined when she tried to use it to buy chips for her 10-year-old daughter at the store. The woman claimed Alba grabbed the snack out of her daughter’s hand — so she knocked over items on the counter and ran home to get Simon, who then stormed into the bodega and attacked Alba about 10 minutes later.

Alba’s daughter Yulissa claims it was self-defense.

“It was either him or the guy at the moment, he’s never hurt, anybody. He’s never had an altercation where he had to defend himself. This is the first time for him.”

According to Alba’s defense attorney during the fight, Simon’s girlfriend allegedly stabbed the worker in the shoulder with a knife she had in her purse however she is not facing charges.

Alba is unable to post the $250,000 bail.
